Member Meetings and the Annual General Meeting are on the agenda. The RCSA is also very active in establishing strong cases in both the Workplace Relations and Occupational Health and Safety legislative areas as the Government continues to introduce policies and changes that require feedback.

Member Action Requested

The RCSA’s Member Meetings and Annual General Meetings require the attendance of as many Corporate Representatives and Accredited Professionals as possible to meet the newly elected Councils and to review the past 12 months. Meeting notices were issued for Region Members and Member Group Councils last month but as a reminder these are the dates and times. Report On Consultation Hearing

RCSA appeared, along with the Ai Group at the consultation hearing on Friday 30th October, 2009 in relation to the coverage of on-hire under Modern Awards.

The hearing was a relatively short one with minimalist submissions by the ACTU and a couple of unions. The ACTU and the unions basically said that they would like to have the issue of on-hire coverage dealt with on an award by award basis rather than the approach proposed by RCSA and Ai Group.

Both Ai Group and RCSA, outlined our written submission HERE and reminded the Full Bench that there had been no written submissions opposing the proposed variation of Modern Award coverage provisions and therefore our submission should be applied by them. The point was made by RCSA that to deal with the on-hire coverage issue on an award by award basis would, in all likelihood, take an extensive period of time and that the industry was going to find it hard enough to address award coverage from 4 December, let alone if there was a delay. The Full Bench said they clearly understood our position and the importance of addressing this matter as soon as possible.

It is now expected that the Full Bench will issue a decision on how they propose to address the on-hire coverage issue and then the parties will be given one further opportunity to submit their responses.

Newshub will keep Members updated as we hear anything further from the Full Bench or the ACTU.

NEW 457/422 Visa Occupation List - effective 22 October, 2009

RCSA has been advised that the previous ‘Specification of Occupations’ (dated, 10 September 09) for subclass 457 and 422 visas has been revoked. It is now replaced with the following Gazette which took effect 22 October, 2009.

Privacy Legislation Review

The Office of the Privacy Commissioner has produced support materials summarising some of the major aspects of the Government's first stage response to the Australian Law Reform Commission's review of privacy law:

RCSA is maintaining a watching brief in anticipation of the changes but anticipated changes in 2010 include:

  • There will be one set of privacy principles covering both the private and public sectorsOpenness will be the first principle – as well as a published privacy policy, organisations and agencies will be required to take reasonable steps to develop and implement internal procedures in line with the policy (covering training, complaint handling, risk management procedures etc)
  • Anonymity will be the second principle but only where lawful and practicable
  • All principles will apply to unsolicited information where an organisation or agency decides or is required to keep the information
  • Obligations relating to the collection and use and disclosure of sensitive information will also apply to agencies
  • The collection of sensitive information will now also be allowed if authorised by law (previously it was only if required by law)
  • Collection of sensitive information will now be allowed where there is a serious threat (no longer also requiring ‘imminence’) however strict parameters will be introduced (basically - not being able to get consent)
  • Collection notices to include whether (and, if possible, where) information may be transferred overseas
  • Use and disclosure permitted for locating missing persons (subject to binding rules issued by Privacy Commissioner)
  • Use and disclosure permitted where a serious threat to life, health or safety (removes imminent) however strict parameters will be introduced (basically - not being able to get consent)
  • Direct marketing will be a separate principle – no age based distinctions
  • Access and correction – the Privacy Act will be the main avenue for access to personal information held by agencies, strengthened ability to obtain some form of access, will generally need to provide reasons for denial of access and give notice to third parties of corrections
  • Government issued identifiers – will not include biometric identifiers but will include state and territory identifiers - there will be an exception where the identifier is being used to verify identity
  • Cross-border data flows – will apply to agencies as well as organisations – organisations and agencies will remain accountable for information transferred overseas with some exceptions (informed consent, required or authorised by law or where recipient subject to obligations similar to Privacy Act principles and there are accessible enforcement mechanisms
  • Collection and use/disclosure available for alternative dispute resolution schemes.
