Thanks to everyone for the feedback on the Recruitment e-Journal, SAVVY and newshub – both positive and negative. Just to clarify: newshub is for everyone who is associated with the RCSA, SAVVY is for the Accredited Professionals and the Recruitment e-Journal is for the Corporate Representative. It is then a company decision how these are disseminated.

As more of the Association’s on-line strategy rolls out there will be no excuse for “not knowing”.

Model OHS Law Released for Public Comment

RCSA welcomes Member feedback on the Model Act to assist the preparation of our submission.  If you have any comments on the draft legislation please email: bsc@rcsa.com.au with the title Model OHS Act in the subject. RCSA will be conducting its own review of the Model Act over the next three weeks.

This is under member action requested currently Join RCSA’s BSC Partner Stratecom in Turning Environmental Concern into Action Enviroweek is a great environmental initiative and Stratecom’s cause is to lobby the Victorian Government about their hypocrisy in relation to claiming they are environmentally aware but are still building new coal fired power stations and exporting coal to India. We need jobs, but not at the expense of the planet!  Might be time to get politicians to think outside the square. read more

Remaginet Welcomes a New BusinessR Company

Anti Competitive Conduct

The UK Office of Fair Trading’s (“OFT”) decision on 30 September to impose penalties in excess of ₤39 million (AUD$72 million) on six UK recruitment firms who boycotted supply to a competitor (“Parc”) when it established for itself an intermediary position with the construction industry, should come as a reminder of the seriousness of engaging in anti-competitive conduct. Similar provisions to those upon which the OFT relied, apply in Australia, where the ACCC has been given authority to investigate and prosecute complaints of anti-competitive conduct. Since July 24, serious criminal cartel offences have been punishable in Australia by terms of imprisonment of up to 10 years. Corporations may also have exposures to claims for civil damages.

VICTORIA: Application for Exclusion from Grouping – Payroll Tax.

The SRO has issued PTA Form 5 'Application for Exclusion from Grouping - Payroll Tax'. The form, which has been adopted by the SRO as part of the payroll tax harmonisation initiative, can be used by employers seeking an exclusion from grouping and aims to ensure consistent treatment of grouping exclusion applications.

Employment Services Award

The AIRC has, in a Statement issued on 25 September, confirmed;

That the Employment Services Award (proposed by NESA) should not be dealt with under Labour Hire Services but under the Social and Community Services Modern Award given it does not apply to on-hired employees. The Full Bench has proposed an Employment Services Award which would apply to the Labour Market Assistance Sector defined as the provision of work placement, job searching, personal support, vocational training and related services in the welfare sector to assist persons seeking employment.

The Ai Group and RCSA filed submissions on the Employment Services award.

AIRC Decides Not to Make Labour Hire Modern Award

The Australian Industrial Relations Commission Full Bench is responsible for making the Modern Awards which will commence from 1 January, 2010.

The Full Bench has, in a Statement issued on 25 September, confirmed that it will not be making a Labour Hire Services Award. No Labour Hire Services Award should be made given that no party supported such an award.

A meeting of the RCSA Workplace Relations Executive will be convened shortly to review the statement and consider our strategy in relation to the multitude of award variation applications relating to labour hire coverage which may ensue.

A recent survey suggests that workplace bullying is still widespread across the country, and organisations are not equipped to manage the systematic change necessary to ensure improved behaviour. This is compounded with the recent increase in the number of cyber bullying reports. Online bullying will need to be addressed under the intended overhaul of sexual harassment laws set to be introduced by the Federal Government.
