Due Diligence & Understanding Workplace Manslaughter  

 

Overview:

Recent changes to the Workplace Safety legislation in Victoria will see the introduction of “workplace manslaughter” as an offence under the OHS Act 2004. This will come into effect on a day to be proclaimed or, at the latest, 1 July 2020.

This will mean, if a person (including officers) is negligent in their conduct, breaches their duty of care under the OHS Act and causes the death of a person, they may face workplace manslaughter as an offence. If convicted of workplace manslaughter, a maximum of 20 years imprisonment for individuals and a maximum fine of $16.5 million for body corporates applies. Victoria are not alone with these laws. Industrial manslaughter laws have been in place in the Australian Capital Territory and Queensland for a number of years now and there is a drive to introduce these laws into other States and Territories. The penalties of workplace manslaughter are hefty, however they can be avoided by exercising due diligence.
