Overview:

Recruitment on-hire agencies have a duty of care to on-hire workers under Work Health & Safety Law.

As a recruiter you do not always have direct control or management of the workplaces involved, however your duty remains as an employer to your on-hire workers. This means that you have a legal duty to take action to establish that the workplace and its operations are safe before workers are placed with a client. You also need to continue monitoring workers’ health and safety throughout the term of their placement.

Regulator guidance for the labour hire industry explains that a key step to ensuring safe work placements is gathering information and visiting the client work-site to understand the client’s operations and hazards, and their approach to managing safety in the workplace.

Guidance and recent labour hire case law highlights that it is essential that the on-hire firm engages competent persons to make an informed WHS assessment of the work-site. This will require knowledge and understanding of the client’s operations, workplace hazards and WHS management systems.

It is common in the on-hire industry for the completion of client site assessments to be delegated to recruitment consultants. In some cases however, the recruitment consultants are not given the knowledge to adequately identify and assess hazards at the client workplace, nor are they confident to recommend risk controls to the client.

Participants will return to their workplace with fresh insight into on-hire work health and safety, armed with goals to work towards and achieve a healthy and safe on-hire business.

This session will be on Wednesday 28th September 2022 from 9.30am - 1.30pm AEST (Melbourne time).

Participants of this workshop will learn to: 
  • Identify work health and safety hazards
  • Assess ricks to health and safety
  • Identify and recommend risk control measures
  • Promote and support worker consultation

Meet the facilitator: Amy Towers


Amy is a committed, curious and tenacious risk wrangler and work health and safety consultant. An advisor with more than 15 years’ experience working with clients to analyse, guide and improve their workplace compliance and productivity while reducing their litigation risk Amy is an incredible asset to the businesses she partners with.

Amy holds a Bachelor of Applied Science (OHS) from RMIT (2002) as well as post-graduate studies in Business Management (2008) and Communication & Organisation from the University of Queensland (2019). She has also completed Lead Auditor Training and attended the Thought Leaders Business School.
