The High Court handed down a highly significant decision on 4 August 2021 which clarifies how the courts will determine when an employee is a casual employee. Whilst this decision was most welcome because it removes the right of an individual to double dip on both casual loading and paid leave, at common law, it is also very significant because it provides clarity on what makes an employee casual or permanent.
