Overview:

This webinar will explore the intricate realm of Australian Consumer Law and the Unfair Contracts Terms legislation. While these may have been overlooked in the past, recent amendments demand our attention.

With an expanded definition of "small business" and the implementation of substantial penalties, the landscape has shifted. Standard form contracts now face scrutiny, with "unfair terms" such as unequal indemnities or liabilities potentially rendering them void or subject to amendment. The stakes are high, with businesses facing fines of up to $50 million, and individuals up to $2.5 million, for non-compliance.

The recent enactment of Closing the Loopholes No2 has also introduced a pivotal change. Independent Contractors, starting August 2024, gain the power to request the Fair Work Commission (FWC) deal with a dispute in cases of unfair contract terms. This development is significant as it opens a more accessible avenue for addressing contractual grievances. However, it's crucial to note that FWC intervention is contingent upon the contract's value falling below the current high-income threshold for unfair dismissal applications, currently set at $167,500.
