Casual Conversion "Check-Up"


Overview:

Casual employment changes passed by the Commonwealth Parliament in March this year included casual conversion provisions that require employers to assess their casual workers to determine their eligibility for conversion to permanent employment.  They must then either offer those employees the opportunity to convert or notify them of the reason they are not being offered conversion. 

This is an enormous administrative task, and with the transition period for the changes ending last month, one that members have now experienced fully.

With that in mind, RCSA thought it would be worthwhile to hold a Casual Conversion “Check-Up” to help us understand the issues, concerns and challenges around the process and to inform our feedback to government on how the changes work in practice.

The session will be hosted by Nick Tindley, Partner at FCB Workplace Law, and Brooke Lord, Head of Advocacy and Policy at RCSA.

The "Check-Up" will be an opportunity to provide a quick re-cap on employers obligations under the new legislation and for members to ask any questions that may have arisen after working through the process in full.  It will also provide an opportunity for RCSA to collect member's feedback, while it is still fresh, ahead of the 12-month review of the legislation.

We encourage members to come ready to share their experiences with the casual conversion process.

While members will be able to ask questions directly during the session, we invite those who may already have questions to submit them here

Meet the hosts:

Nick Tindley
Partner at FCB Workplace Law and Executive Manager of HR Consulting and Advisory Services at FCB HR

Nick Tindley is a partner with FCB Workplace Law and the Executive Manager of HR Consulting and Advisory Services at FCB HR. He has over 12 years' experience in providing industrial relations and employment law advise, with particular expertise in the retail industry. In his role as Executive Manager, Nick supervises both the consulting and advisory teams at FCB HR and is responsible for managing a number of key client relationships.

At FCB HR, Nick's areas of expertise include:

  • Negotiating enterprise agreements;
  • Managing No-Disadvantage Test/Better Off Overall Test compliance;
  • Drafting and reviewing employment contracts;
  • Managing executive terminations and redundancies;
  • Managing underpayment claims;

Head of Advocacy and Policy at RCSA

Brooke Lord is RCSA Head of Policy & Advocacy, an executive corporate affairs professional with experience heading up government, communications and corporate affairs functions for a number of high profile businesses and organisations in both public and private sectors.
